General Notes

Scope. This list covers standards that contemplate Level 3-5 automated driving as defined in GB/T 40429-2021 (broadly paralleling the SAE J3016 levels). It excludes standards addressing only driver assistance (e.g., GB 47955-2026 regarding Level 2).

Significant Recent Changes

  • 25 Aug 2026—national Road Traffic Safety Law revision reaches first reading. The draft revision of the 《中华人民共和国道路交通安全法》 was submitted to the Standing Committee of the National People's Congress for first reading. State-media reports describe a new dedicated chapter, 《自动驾驶汽车的特别规定》, defining automated-driving vehicles and driver-assistance functions, requiring an automated-driving vehicle to pass a road-traffic-rules compliance test and register before public-road operation, allocating handling of traffic violations occurring while the automated-driving function is active to the manufacturer or importer, applying compulsory motor-vehicle traffic-crash liability insurance, and imposing road-safety, cybersecurity, data-security, and truthful-marketing duties. No full first-reading text was located on an NPC or State Council site as of this update (26 Aug 2026 China time), so the entry below distinguishes reported provisions from the unpublished bill text.
  • 30 Jul 2026—GB 44721-2026 issued. China's first mandatory national standard specifically for Level 3 and Level 4 automated driving systems, 《智能网联汽车 自动驾驶系统安全要求》, was approved and published as GB 44721-2026 on 30 July 2026 and will take effect 1 July 2027. It therefore moves from the "under development" section into the mandatory-national-standard section below and will fully replace GB/T 44721-2024 when effective.
  • 1 Jul 2026—GA/T 2388-2026 in force; official MPS record verified. The Ministry of Public Security record confirms that 《智能网联汽车道路测试与示范应用安全通行规范》 is current, was issued 28 Feb 2026, and took effect 1 July 2026. The official MPS page currently provides the standard record rather than a publicly downloadable full text; an unofficial reproduction is linked below.
  • Traffic-rules compliance testing gains potential statutory significance. Mandatory-standard plan no. 20260050-Q-312, 《智能网联汽车 道路通行规定符合性测试内容和方法》, remains in drafting. The 25 Aug 2026 Road Traffic Safety Law revision, however, is reported to require an automated-driving vehicle to pass a road-traffic-rules compliance test before registration and public-road use. If that requirement survives enactment substantially as reported, the planned mandatory standard appears positioned to supply the technical test content and methods for that statutory road-access prerequisite.

Types of Law and Standards

Chinese legislation and technical standards are separate but interacting systems. The Legislation Law (立法法; amended 2023) governs the hierarchy of laws, administrative regulations, local legislation, and rules. The Standardization Law (标准化法; revised 2017) separately governs national, sectoral, local, group, and enterprise standards. A technical standard may be binding because it is itself mandatory, or may acquire additional legal significance when legislation, regulations, permits, administrative instruments, or contracts require compliance with it.

National laws (法律). Enacted by the National People's Congress (NPC) or its Standing Committee. Under the Legislation Law, laws rank below the Constitution but above administrative regulations, local regulations, and rules. A legislative draft has no binding legal effect unless and until enacted. The Road Traffic Safety Law is a national law; the 25 Aug 2026 revision discussed below is currently only a draft submitted for first reading.

Administrative regulations (行政法规). Enacted by the State Council under the Constitution and laws. They commonly use titles such as 条例 ("regulations"), 规定 ("provisions"), or 办法 ("measures"). Their legal effect is below national laws but above local regulations and rules. State Council regulations implementing the Road Traffic Safety Law can therefore supply nationwide operational detail beneath the statute.

Local regulations and special-economic-zone regulations (地方性法规、经济特区法规). Local legislation is enacted by the people's congresses or standing committees of provinces, autonomous regions, province-level municipalities, and other authorized jurisdictions, and applies within the relevant territory. Local regulations must conform to superior law; under statutory authorization, special-economic-zone regulations may make specified adaptations to laws, administrative regulations, or local regulations within the zone. The Shenzhen ICV Regulations and Beijing Autonomous Vehicles Regulations listed below are local legislation rather than technical standards or ordinary administrative documents.

Rules (规章). Formal administrative rules comprise State Council departmental rules (部门规章) and local-government rules (地方政府规章). They are subordinate to laws and administrative regulations; local-government rules are also subordinate to applicable local regulations. Not every document issued by a ministry, bureau, or local government is a formal 规章: the issuing authority, procedure, and legal form matter.

Administrative normative documents and other policy instruments (行政规范性文件及其他政策文件). The State Council defines administrative normative documents as generally binding, repeatedly applicable administrative documents issued under lawful authority outside formal administrative regulations, State Council decisions/orders, and formal rules (State Council General Office). They must conform to superior law and generally may not create matters reserved to laws, regulations, or rules, such as administrative licensing, penalties, or coercive measures. Many of the notices, opinions, trial measures, implementation rules, and pilot documents on this page fall in or near this category, although the precise legal character of each instrument depends on its issuer and form. Strategies, plans, guidelines, interpretations, and similar policy documents may guide administration without themselves having the same legal status as laws, regulations, or rules; this page identifies them individually rather than treating all government documents as equivalent.

The Standardization Law recognizes five categories of standards: national, sectoral, local, group, and enterprise standards. National standards may be mandatory or recommended; sectoral and local standards are recommended. Mandatory standards must be implemented, while the state encourages adoption of recommended standards. Recommended national, sectoral, and local standards—and group and enterprise standards—may not set technical requirements below the relevant mandatory national standards.

National standards (国家标准, GB). Applicable nationwide. Plain GB standards are mandatory national standards (强制性国家标准); GB/T standards are recommended national standards (推荐性国家标准), and GB/Z denotes national guiding technical documents. Mandatory national standards are approved and issued through the national standardization system and must be complied with: products or services that do not comply may not be produced, sold, imported, or provided. Recommended national standards commonly supply foundational terminology, test methods, and technical detail supporting mandatory requirements.

Sectoral standards (行业标准). Issued by competent State Council departments for technical requirements that need nationwide uniformity within an industry where no recommended national standard exists. Under the current Standardization Law and Industry Standard Management Measures, sectoral standards are recommended standards and their technical requirements may not fall below applicable mandatory national standards. The Ministry of Industry and Information Technology (MIIT) uses YD for telecommunications and QC for automotive; the Ministry of Transport (MOT) uses JT for general transport and JTG for highway engineering; and the Ministry of Public Security (MPS) uses GA. The /T in standards such as GA/T 2388 identifies them as recommended.

Local standards (地方标准, DB). Recommended standards issued for special local technical needs by provincial-level standardization authorities and, with provincial approval, authorized city-level authorities. The region's administrative code appears in the designation (DB11 Beijing, DB31 Shanghai, DB4201 Wuhan, DB4403 Shenzhen). They apply within the relevant jurisdiction and may not set technical requirements below applicable mandatory national standards. A local standard is distinct from a local regulation: DB4403/T 358-2023, for example, is a technical standard, while the Shenzhen ICV Regulations are local legislation.

Group standards (团体标准, T/). Market-developed standards issued by eligible societies, associations, chambers of commerce, federations, industrial-technology alliances, and similar social organizations. They are adopted by agreement of members or voluntarily by other market actors rather than being mandatory merely because they are published. Their technical requirements may not fall below mandatory national standards. A group standard can nevertheless become practically or legally required within the scope of a permit, contract, procurement rule, or administrative instrument that incorporates it, as occurred with T/CMAX under Beijing's earlier road-test regime.

Enterprise standards (企业标准, Q/). Standards developed by enterprises for their own products, services, or operations. Enterprises may adopt their own standards where needed and may set requirements above recommended standards, but enterprise standards must comply with laws, regulations, and applicable mandatory standards. China uses a self-declaration and public-supervision system for enterprise standards. None are included in this selected list.


National Legislation and Draft Legislation

中华人民共和国道路交通安全法(修订草案) [Road Traffic Safety Law revision—AV chapter]

Draft Revision of the Road Traffic Safety Law of the People's Republic of China

《中华人民共和国道路交通安全法(修订草案)》

Status and issuing process. A State Council bill submitted to the Standing Committee of the National People's Congress for first reading on 25 Aug 2026. State-media reports describe the bill as nine chapters and 170 articles, including a dedicated chapter entitled 《自动驾驶汽车的特别规定》 ("Special Provisions on Automated-Driving Vehicles"). It is a draft, not enacted law.

Summary. According to Xinhua and other state-media reports, the draft distinguishes automated-driving vehicles from vehicles/functions that merely assist the driver: an automated-driving vehicle performs the entire dynamic driving task continuously and automatically in place of the driver within its design operating conditions, whereas driver assistance helps the driver perform only part of the dynamic driving task. An automated-driving vehicle must pass a road-traffic-rules compliance test and be lawfully registered before public-road operation. When a road-traffic-safety violation occurs while the automated-driving function is active, the manufacturer or importer is to accept the violation handling. Xinhua further reports that if the manufacturer or importer contends that the violation was unrelated to the automated-driving function, it bears the burden of proof. When the automated-driving function is not active, and for vehicles equipped only with driver-assistance functions, the ordinary rules for nonautomated vehicles apply. Reports also describe compulsory motor-vehicle traffic-crash liability insurance and manufacturer/importer duties concerning road-operational safety, cybersecurity, data security, and truthful marketing. Xinhua's 26 Aug account states more generally that the draft establishes principles governing automated-driving vehicle access, road operation, crash investigation and handling, vehicle-data processing, and insurance. More detailed public reports state that automation may be activated only within the vehicle's design operating conditions, that manufacturers/importers must prevent activation outside those conditions, and that police may obtain relevant automated-driving data when investigating a crash; those details should still be checked against the bill itself when the first-reading text becomes public.

Relationship to standards. The draft would place a national statutory road-use layer above the technical standards and pilots catalogued on this page. Its reported distinction between automated driving and driver assistance tracks the "entire dynamic driving task" architecture of GB/T 40429-2021 and the ICV terminology system in GB/T 44373-2024. Its use of design operating conditions gives additional legal significance to GB/T 45312-2025. Most importantly, the reported pre-road-use compliance-test requirement corresponds directly to mandatory-standard plan no. 20260050-Q-312; GB 44721-2026 supplies the mandatory ADS product-safety baseline, while GB 44497-2024 supplies the mandatory automated-driving data-recording layer. The draft also appears to move China toward a general statutory framework for road access beyond the 2023 L3/L4 access pilot, although that pilot remains the operative mechanism unless and until legislation and implementing rules provide otherwise.

Text status. No full text of the 25 Aug 2026 first-reading bill was located on an NPC or State Council website as of 26 Aug 2026 China time. The summaries above therefore identify reported provisions rather than presenting them as verbatim statutory text.

National Mandatory Standards (GB)

GB 44721-2026 was issued on 30 July 2026 as China's first mandatory national standard specifically for Level 3 and Level 4 automated driving systems; it takes effect 1 July 2027. GB 44495-2024, GB 44496-2024, and GB 44497-2024 were issued on 23 August 2024 with formal effective dates of 1 January 2026, establishing mandatory cybersecurity, software-update, and automated-driving data-recording requirements for intelligent and connected vehicles (智能网联汽车, ICV). Amendment No. 1 to GB 44495 and GB 44496 was approved and took effect on 28 January 2026, limiting the applicable vehicles to M and N categories and providing that the two standards apply to vehicle types newly applying for type approval from 1 July 2026 (official amendment announcement; implementation notice). An earlier mandatory standard on event data recorders (GB 39732-2020) applies principally to M1 vehicles equipped with an EDR.

GB 44721-2026 [L3/L4 ADS safety]

Intelligent and connected vehicle—Safety requirements for automated driving system

Issuing authority. Issued by SAMR and SAC; developed under MIIT through the ICV subcommittee (SC34) of TC114.

Summary. China's first mandatory national standard specifically for Level 3 and Level 4 automated driving systems. Issued 30 July 2026 and effective 1 July 2027; the official SAMR record states that it will fully replace GB/T 44721-2024. Applies to M- and N-category vehicles with Level 3 and/or Level 4 driving automation and excludes automated parking systems. MIIT describes three principal layers: (1) manufacturer lifecycle safety-assurance requirements, including safety management and a safety file; (2) ADS safety requirements intended to ensure safety performance no lower than that of a qualified and attentive driver, including activation, dynamic-driving-task execution, exit, human-machine interaction, L3 user takeover-capability monitoring, user information, and training; and (3) an inspection framework combining review of enterprise safety assurance and the safety file with confirmation testing. Third-party testing is organized around the national track, road, and simulation standards GB/T 41798, GB/T 44719, and GB/T 47025. MIIT states that the standard fully covers the core technical requirements of UN GTR No. 26 while adding implementation-oriented national requirements. The June 2026 approval draft contained additional quantitative requirements and a normative safety-case annex; because the final full text had not yet appeared in the Openstd full-text viewer as of this update, draft-specific numerical details should be checked against the final published text before being quoted as final requirements.

Supports crash reconstruction and responsibility investigations. Reported provisions of the 25 Aug 2026 Road Traffic Safety Law revision would expressly facilitate police access to relevant automated-driving data in crash investigations, giving this mandatory recording layer additional statutory significance if retained in the enacted text. Summary. Planned mandatory standard specifying test contents and methods for verifying that ICVs comply with road-traffic rules; plan issued 27 Jan 2026 with an 18-month project cycle and remains in drafting (正在起草). The project record describes three complementary test pillars—simulation, closed-site testing, and actual-road testing—and five broad scenario dimensions: passage through characteristic road environments, understanding and response to traffic signals, special environments, interaction with other road users, and prediction/response to traffic risk. It also describes quantitative coverage expectations for the three pillars and identifies a related public-security sector-standard project, 2025BZ005, as the source being converted into a national standard. GA/T 2388-2026 (below) supplies conduct requirements for test and demonstration vehicles; this planned GB supplies the compliance-test content and methods. The 25 Aug 2026 Road Traffic Safety Law revision is reported to require an automated-driving vehicle to pass a road-traffic-rules compliance test before registration and public-road operation. International Instruments

China is a contracting party to the 1998 Agreement Concerning the Establishing of Global Technical Regulations for Wheeled Vehicles, Equipment and Parts Which Can Be Fitted and/or Be Used on Wheeled Vehicles. It participates in the World Forum for Harmonization of Vehicle Regulations (WP.29) and its Working Party on Automated/Autonomous and Connected Vehicles (GRVA).

An established UN global technical regulation (GTR) does not by itself become a domestic vehicle-compliance rule in China. Under Article 7 of the 1998 Agreement, a contracting party voting in favour of a GTR must submit it to its domestic process for adoption into its laws or regulations and subsequently notify the United Nations of adoption or a decision not to adopt it. China has now issued a domestic mandatory ADS safety standard, GB 44721-2026, that MIIT says keeps its core technical requirements coordinated with the ADS GTR while adding more detailed requirements adapted to China's road environment and regulatory system. Issuance of the domestic standard is distinct from any later formal notification by China under Article 7 of the 1998 Agreement concerning adoption of the GTR into domestic law or regulations.

China is not a contracting party to the 1958 Agreement and therefore has no treaty obligation under that Agreement to apply UN Regulations or recognize approvals issued pursuant to them. This does not prevent China from incorporating or referring to their technical provisions in domestic law or standards.

UN GTR No. 26 — Automated Driving Systems

United Nations Global Technical Regulation on Automated Driving Systems (ADS GTR)

Summary. The first UN global technical regulation specifically addressing automated driving systems. It was established by consensus vote of the contracting parties represented and voting in the Executive Committee of the 1998 Agreement (WP.29/AC.3) during WP.29's 199th session on 24 June 2026. In parallel, the Administrative Committee of the 1958 Agreement (WP.29/AC.1) adopted a new UN Regulation on automated driving systems, assigned UN Regulation No. 185.

As of 26 Aug 2026, the accompanying Guidance and Interpretation Document (GID) had not been finalized. A formal draft, ECE/TRANS/WP.29/GRVA/2026/24, is posted for consideration at GRVA's 26th session in Geneva on 14-18 Sept 2026.

Chinese participation. China has held a GRVA vice-chairnship since February 2019. It co-chaired the earlier informal working group on Functional Requirements for Automated and Autonomous Vehicles (FRAV) and, according to MIIT, served as a co-chair country of the ADS informal working group through more than twenty sessions over more than two years of drafting.

MIIT organized participation by the China Automotive Technology and Research Center (中国汽车技术研究中心, CATARC) and the China Academy of Information and Communications Technology (中国信息通信研究院, CAICT); hosted multiple ADS meetings and workshops; led work on the technical background, drafting principles, and technical rationale; convened a national expert group on the GTR; and contributed closed-course, public-road, and vehicle–road-coordination testing, validation, and real-vehicle application data. China also submitted dozens of technical proposals concerning the dynamic driving task, human-machine interaction, and testing and validation methods.

Relationship to domestic standards. The formal report of GRVA's January 2026 session records China as stating that its corresponding national regulation was based on the draft GTR but contained additional and more detailed provisions adapted to China's national regulatory system. UNECE subsequently reported that China intended to follow the GTR's structure and collect comments. China opened public consultation on the mandatory national ADS safety standard in February 2026, publicized an approval draft in June, and issued the final standard as GB 44721-2026 on 30 July 2026, effective 1 July 2027. MIIT's 4 Aug 2026 interpretation states that GB 44721 retains coordination with the GTR's core technical requirements while adding more detailed L3/L4 requirements, user information and training provisions, and a unified standardized test-scenario system tailored to China's road environment and regulatory needs.
